Welcome to MotoSwop. These Terms govern your access to and use of our website and services in South Africa. By creating an account, listing a bike, sending an enquiry, or browsing the site you agree to these Terms.

1. Who we are

MotoSwop is a South African online advertising platform where sellers post motorbike listings and buyers connect with them to arrange in person viewings. MotoSwop is not an escrow, courier, or dealership.

2. What MotoSwop provides

  • A website where sellers can create accounts, publish listings, and receive enquiries
  • Listing templates with fields for bike details and photos
  • Basic profile verification steps and light listing moderation
  • Tools for buyers to contact sellers via enquiry form or WhatsApp

We do not hold or release money for bike sales. We do not deliver, store, inspect, or repair bikes. Any sale happens directly between buyer and seller after an in person viewing.

3. Accounts and eligibility

  • You must be 18 or older and able to form a binding contract
  • Keep your login secure and update your details when they change
  • You are responsible for all activity on your account
  • We may pause or close accounts that break these Terms or our policies

Dealers are welcome to use the platform within the limits of our MVP. Bulk import tools are not included at launch.

4. Listing rules for sellers

Create honest listings that help buyers make good decisions. By publishing a listing you confirm that:

  • You have the right to sell the bike and it is located in South Africa
  • Details are accurate and not misleading, including make, model, year, mileage, engine size, condition, and location
  • Photos are your own or you have permission to use them and they show the actual bike
  • You will disclose known issues that affect safety or value
  • You will bring proof of ownership and relevant documents to a viewing
  • You will mark the listing as Sold when the bike is sold

Content that is illegal, abusive, fraudulent, or violates third party rights is not allowed. We may remove such content without notice.

5. Enquiries and off‑platform communications

  • Buyers contact sellers via our enquiry form or by opening a WhatsApp chat
  • Once you leave our site to WhatsApp, you are subject to WhatsApp’s terms and privacy rules
  • Keep all conversations respectful and lawful. Do not send payment links or request copies of IDs by message. Show documents in person

6. Safety

We provide a Safety guide and a Report Listing feature. Use public meeting places with good light, verify the VIN against documents, and only pay when you are satisfied after inspection. MotoSwop does not guarantee the condition of any bike or the conduct of users.

7. Payments and fees on MotoSwop

  • Browsing is free for buyers
  • Sellers pay for listing plans and optional Featured placement as set out on the Pricing page
  • Plans run for a defined period. You can edit listings during the active period and mark them as sold
  • Payments for listing plans are processed by our payment processor. We do not store full card details
  • Fees for advertising are non‑refundable except where required by law or as allowed by our Refunds and Cancellations policy

MotoSwop does not process payments for bikes. The sale price is settled directly between buyer and seller.

8. Moderation and verification

  • We run light checks to reduce spam and obvious scams
  • A basic verification badge may appear on seller profiles when checks are complete
  • Moderation and verification reduce risk but cannot eliminate it. They are not endorsements or guarantees
  • We may edit, hide, or remove listings that break rules or attract repeated complaints

9. Intellectual property and licence

  • You retain rights in the content you post
  • You grant MotoSwop a worldwide, non‑exclusive, royalty‑free licence to host, store, display, and distribute your listing content for the purpose of operating and promoting the platform
  • Do not copy, scrape, or reuse content from the site without permission

10. Prohibited uses

Do not use the site to:

  • Break the law or infringe rights
  • Misrepresent a bike or tamper with mileage or VIN information
  • Upload viruses, attempt to hack, or disrupt the site
  • Harvest personal information or send spam

11. Third‑party services

Our site links to third‑party services such as WhatsApp, maps, analytics, and payment processors for listing plans. Their terms and privacy policies apply to your use of those services.

12. Warranties and liability

The site is provided “as is” and “as available.” To the fullest extent permitted by law, MotoSwop disclaims all warranties, express or implied, including fitness for a particular purpose and non‑infringement.

To the fullest extent permitted by law, MotoSwop is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the site, listings, or any transaction between buyers and sellers. Our total liability for any claim relating to the site will not exceed the amount you paid to us for listing fees in the 3 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under South African law.

13. Indemnity

You agree to indemnify and hold MotoSwop harmless from claims, losses, damages, and legal fees arising from your listings, your conduct on the site, or your breach of these Terms or the law.

14. Suspension and termination

We may suspend or terminate accounts or listings that violate these Terms or harm other users. You may stop using the site at any time. Sections that by their nature should survive termination will survive, including intellectual property, fees, liability, and dispute terms.

15. Disputes and governing law

Any dispute between a buyer and seller about a bike is a private matter between those parties. MotoSwop is not a party to the sale.

These Terms are governed by the laws of South Africa. You agree to the jurisdiction of the South African courts.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. If changes affect your rights materially, we will notify you through the site or by email where appropriate. Your continued use of the site after changes means you accept the updated Terms.
